Hi, I was hired 6 months ago as an Electrical Engineer and I am now preparing to apply for GC thru company Sponsorship. I have MS + 2 years and the position requires BS+7.
1. Am I qualified for EB2?
2. Which level do I fall under? Do you think the figures at the link below more or less right for privailing wage?

Sorry to hear about your upcoming hardship..
I 've had a similar situation recently - where my H1B (with employer A) was about to expire and then another employer (B) had to recruit me, they filed for transfer+extension.
In I129 while filing, they would have to select (cant recall the exact verbiage) new employer (related to transfer) AND extension of current status. Its better to file this kind of petition premium. I got the new approved petition within 2 weeks with new expiry date as +2yrs, with start date earlier than the H1B expiry date (with A).

( i dont know exactly but something i listened this )on h1 we should do the job continuously with out any gap. if one is not working on h1 for more than 180 days staying here is not legal or that may be out of staus.
like that who is on valid AOS(not primary applicant) dont want to do job means is there legality issues or out of status issues . is there any particular time limit for not doing job with AOS/EAD( not primary person). If i am wrong anything please correct me.

It used to be required only for Mumbai Consulate. But I think Hyderabad has also started. Please check

Anoop - dont worry about it and ask your company to reapply with a stronger educational valuation. Everything depends on the educational valuation report submitted along with the application.

Do you know your I-485 receipt number? If yes, then request FOIA to get all the documents attached to your I-485 case number, then they will send you all the documents in your I-485 case file and I-140 document will be there in it. You might also need to enter your A# in FOIA request.
If you dont know your I-485 receipt number then I am not sure how to send FOIA request.

no it doesnt....check on ..there are so many people getting consecutive luds...but then they dont get approvals. in the end it means that its a new lud. someone accessed your case and the lud was either because some accessed it or it was a system generated lud.
i hope that eb2-june03-dude gets his green soon...but the lud doesnt mean anything

I got EAD on February 2008 with my primary GC employer. My PD is just 4 months away and I got a job offer in a big company which I cannot afford to loose.
The the job duties in my new job remain the same but I am worried to change job during this time when PDs are jumping very fast. The max I can delay the joining my new employer cannot be more than a 1 month. Please suggest the best approach...
The best approach is to go ahead and change the job. What are you worried about? File AC 21 via new company's lawyer.

Hello All,
I am going to India and have to go for stamping. I come under Chennai consular district but planning to go to Delhi because of high rejection rate in Chennai.
First thing, I am not sure if I can go to Delhi when I come under Chennai consular district.
Second thing is, should there be a valid reason with supporting documents for attending the visa appointment in Delhi instead of Chennai.

with experience you gain not only technical skills required to do your job, but also you gain project management experience. To be successfull in consulting world, you need to have strong project management skills and people management skills that come with experience... At least that's what I see in my company - one of the "big- four" firms (accounting, assurance and advisory services). Hope that helps

my company lawyer did not ask for any tax returns or w2 forms .. Should they be submitted as part of "initial evidence"
Tax returns are not part of "initial evidence". You have to provide them if asked by the USCIS.
BTW, the IRS will mail you tax transcripts for free if you call them. You will get them within a few days.

1) In DS156 should my answer to the Question� �Has Anyone Ever Files an Immigrant Petition on your behalf� be NO. FYI, my 140 is approved and waiting on 485 priority date. I don�t think I gave my wife�s name yet in my labor or 140 approval process

Since your spouse is working, You can look for consulting position in east coast ,get the project and file for H1 ,file for green card simultaneosuly assuming your 5th year completes by November 2010 (not 6th year, you mentioned H1 valid until November 2010). You still have 6 full months time.

I mailed my I-765 along with cashier's check for $340 on dec, 17 , still waiting for receipt notice. I call customer care number today since its more than 30 days, but they are closed today.
I have USPS confirmation that they have received case on Dec 19.
I will try calling them tomorrow.

You can take $5k each in cash. And unlimited if it is Travellers checks.ON Travellers checks you are going to pay commission and crap. I do not personally recommend it. I do not know how it is working now adays. You can check on department of homeland or customs website to find exact amount that you can take as cash. And do not take more than what is recommended.
